Apple knew about it before launching the device, it alleges

A new class action lawsuit has been filed against Apple, this time accusing the company of launching the Apple Watch with a defective screen.

The lawsuit alleges that absolutely all generations of the Apple Watch come with a broken display that can eventually crack, shatter, or even detach completely. Furthermore, Cupertino is being accused of knowing about the issue before the launch of the device, but bringing it to the market anyway.

“The Watches all contain the same defect and/or flaw, which causes the screens on the Watches to crack, shatter, or detach from the body of the Watch (the “Defect”), through no fault of the wearer, oftentimes only days or weeks after purchase,” the lawsuit claims according to PatentlyApple.

Apple also refuses to repair or replace the defective units under warranty, instead blaming accidental damage to the device, the complaint reads.

All Watches affected
Absolutely all Apple Watch models launched with the same issue, it adds, and Cupertino received reports of such problems from customers shortly after every new generation went on sale.

“Apple knew that the Watches were defective at or before the time it began selling them to the public. Furthermore, consumers complained to Apple about the Defect almost immediately after Apple released the Series 0, Series 1, Series 2, and Series 3 Watches,” the lawsuit alleges.

Apple has never confirmed a display issue on the Apple Watch, despite the company actually offering extended warranties after discovering a bug causing batteries to inflate on several models.

The lawsuit demands Apple to pay $5 million in damages, noting that the issue was first reported on the Series 0 Watch launched in 2015. Similar complaints were posted on Apple’s Communities forum shortly after the launch of new-generation models as well, but none of them triggered a recall from Apple for defective screens.
